You linked to this Privacy Policy ("Privacy Policy") via a product website owned by DDKarma, LLC, d/b/a Dermaflash ("Company", "us", "our" or "we"). The Company’s network includes numerous product marketing websites (each a "Website" and collectively, the "Websites"). This Privacy Policy applies to all Websites owned and operated by the Company.

In this Privacy Policy, we describe how we collect, use, store, share and disclose your Personal Information.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal Information does not include publicly available information or aggregated information that does not include personal identifiers.

We collect the following categories of Personal Information about you when you visit our Websites, or otherwise interact with  us.

Identifiers.  Contact information such as your name, billing and delivery addresses, and email address.  If you choose to have your purchase delivered to another person’s address, we will collect that person’s name and delivery address.

Customer Records.   Your name, address, telephone number, credit or debit card number (do you get back last 4 digits).

Commercial Information.  Information about your purchases and related transactions.

Demographic Information. If you volunteer such information, demographic information such as your age, gender or estimated income.

Internet or Other Electronic Network Activity.  We may collect Personal Information using technology related to your use of the internet and your devices, such as your IP address, browser ID, device functionality (including browser, operator system, hardware, mobile network information), device location, device characteristics, city, time zone, and referring URL when you use our Websites.

Professional or Employee Related Information.  We may collect Personal Information from you when you apply for a job or during the course of your employment with us.

Education.  We may collect Personal Information related to your educational background when you apply for a job or during the course of your employment with us.

We may collect your Personal Information from the following sources:

Information you Provide To Us. We may collect Personal Information which you provide us directly when you visit our Websites or otherwise communicate with us.

Using Technology.   We use cookies and other tracking technologies, as defined in Section 7 below, in order to collect and store information concerning your use of the Websites.  This includes information such as which pages are most popular and remembering you and your preferences, your IP address, unique identifiers, device functionality (including browser, operating system, hardware, and mobile network information), device location, device characteristics, city, time zone, and referring URL.  This usage information may be stored or accessed using a variety of technologies that may be downloaded to your personal computer, browser, laptop, tablet, mobile phone or other device whenever you visit or interact with our Websites.

Information Provided by Third Parties.  We may collect Personal Information from third parties such as information we receive from payment processors when you make a purchase, from service providers that deliver marketing communications on our behalf, and from third parties which help us understand traffic and usage of our Websites.

5.wITH WHOM we Share or Disclose Personal Information 

We may share or disclose your Personal Information with others including as followings:

  • Service Providers. We may disclose your Personal Information to certain persons or organizations that provide us  support services.  For instance, we use email and hosting services providers, credit card processors, shipping companies, data management service providers, marketing companies, IT service providers, promotional service providers, and companies that assist in preventing or deterring fraud. (“Service Providers”) We may disclose Personal Information to our  Service Providers solely as appropriate for them to perform their functions pursuant to a written agreement, but they are not permitted to use such information for any other purpose. We do not share your credit card information with unaffiliated third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities, including, but not limited to, delivering a product or service that you order.

 

  • Third Parties. We may share your Personal Information, (e.g. – your name, email address, mailing address and/or telephone number) with social media platforms, our business partners and other third party organizations to provide you with information about products, services and special offers we think may interest you. Some of our pages utilize framing techniques to serve content to or from our partners. Please be aware that you are providing your Personal Information to these third parties and not to Company
  • With Professional Advisors. We may disclose your Personal Information to  our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to us in order to provide us professional advice.
  • With Government Officials and Law Enforcement. We may disclose Personal Information to meet legal obligations and to respond to governmental subpoenas or court orders; when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with  the rights of the Company, to anyone that could be harmed by such activities  or as otherwise required by law.  We may also share Personal Information as necessary in response to threats of physical safety. 
  • Parties to a Business Transaction. We may disclose or share Personal Information when we engage in certain business transactions.  For instance, we may share Personal Information in connection with a merger, consolidation, restructuring, the sale of substantially all of our equity interests and/or assets or other corporate change, including, during the course of any due diligence process.  We may transfer ownership of our rights in the Personal Information to a subsequent owner, co-owner or operator of our Websites or applicable databases.

6. USE OF DEIDENTIFIED OR AGGREGATE INFORMATION

We may use Personal Information in an aggregate or deidentified manner for internal business purposes, such as generating statistics, developing marketing plans, customizing content, and improving the Websites.  If we deidentify your Personal Information, we will not attempt  to reidentify that Personal Information.

  1. COOKIES AND OTHER TRACKING TECHNOLOGIES

We use cookies, beacons, pixels, tags and other tracking technologies to serve you targeted advertising and to perform analytics regarding use of  the Websites. (“Cookies and Other Tracking Technologies”)  We  may use  tracking technologies in connection with our Websites, which may include the collection and storage of information about your online activities over time and across third-party websites or online services.  We receive reports based on the use of these Cookies and Other Tracking Technologies on a de-identified and aggregated basis. Our advertising and analytics partners may combine the Personal Information collected when you visit our Websites with Personal Information collected from other third-party sources. 

  • Targeted Advertising. We and our third party partners  use third-party cookies, to collect or receive information to serve you with targeted advertising. Our third party ad network and exchange providers, the advertisers and/or traffic measurement services may themselves set and access their own technologies on your device and track certain behavioral usage information via a device identifier.

We use the services of Yahoo!  to collect information about goods and services of interest, including, in connection with the collection of information to provide targeted advertising to you. We use reasonable physical, administrative and  technical safeguards to protect the security of your Personal Information.  Please note, however, that although we employ such security measures, there is always a risk in sending Personal Information over the  Internet.

You have certain choices to limit the collection or use of your Personal Information, including Personal Information collected when you use of our Websites. 

Browser Settings. Most browsers automatically accept Cookies. You can disable this function by changing your browser settings, but disabling Cookies may impact your use and enjoyment of the Websites. You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Websites. You can manually delete persistent Cookies, or Cookies that track your activity across websites, through your browser settings.

Requests to Correct, Update or Delete Data.   If your Personal Information changes, or if you no longer desire to receive communications from us, you may correct, update, amend, delete/remove, or deactivate it by making the change on our member information page, by emailing our Customer Support at privacy@dermaflash.com or by contacting us by telephone or postal mail at the contact information listed below. We will respond to your request within a reasonable timeframe.

E-Mail Marketing.  If for any reason you would no longer like to receive email marketing messages from the Company, you may follow the instructions contained within our promotional emails or please click here. Please allow up to ten (10) days for us to process your request. This will not affect subsequent subscriptions and if your opt-out is limited to certain types or categories of emails the opt-out will be so limited. Please note, if you opt not to receive marketing emails from the Company, you may still receive "transactional" email messages regarding your account, use of the Websites or your order (e.g., order confirmation, shipping information, recall notices, customer service notifications, etc.). All of our Websites are intended for a general audience. We do not knowingly collect Personal Information from children under the age of 13. We will delete any Personal Information collected that we later determine to be from a user younger than the age of 13.   1. EXTERNAL LINKS

Our Websites may offer links to and from other third party sites. Other sites have their own privacy policies. If you visit one of these sites, their privacy policy will apply to any Personal Information they collect on those sites, rather than this  privacy policy.

  1. SOCIAL MEDIA

Our Websites include social media features (“Features”), such as the Facebook Like button, and widgets, the “Share This” button or interactive applications or mini programs that run on our Websites. These Features may collect your IP address, which pages you are visiting on our Websites, and may set a cookie to enable the Feature to function properly. The use of this functionality may involve the third-party operator providing certain information, including Personal Information, to us. If you click on social media icons on the Websites (such as for Facebook, X or Instagram), those actions may be associated with, and we may have access to, the  Personal Information you provided on those third-party sites or applications. Our Websites may, from time to time, offer publicly accessible blogs or community forums where you can submit ideas, photographs, writings, music, video, audio recordings, computer graphics, pictures, data, information about your location, questions, comments, suggestions or other content (“User Content”), including Personal Information. You should be aware that any User Content  you provide in these areas may be read, collected, and used by others who access them. Please note that we do not control who will have access to the User Content that you choose to make public, and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why. We are not responsible for the privacy or security of any User Content that you make publicly available on the Websites or what others do with the User Content you share with them on the Websites. We are not responsible for the accuracy, use or misuse of any User Content that you disclose or receive from third parties through the Websites.

  1. INTERNATIONAL USERS

Our Websites are operated in the United States and intended for users located in the United States. We do not target customers outside the United States.  If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, and processed, stored and used in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States. California Civil Code Section 1798.83 permits California residents to request and obtain from us once a year, free of charge, information about the Personal Information (if any) we disclosed to third parties for the third parties’ direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding twelve (12) calendar months.
